Implementation of Diversion for Child Perpetrators of the Criminal Act of Distributing Obscene Content at the District Prosecutor’s Office of Mojokerto Regency

Abstract

Diversion is a process of resolving child cases outside the criminal justice system that emphasizes restorative justice. This study aims to evaluate the implementation of diversion for child perpetrators of the crime of spreading immoral content at the Mojokerto District Attorney's Office. The method used is empirical juridical, with data collection through interviews and literature studies. The results of the study indicate that the implementation of diversion is still not optimal, due to a lack of public understanding, low victim participation, and challenges in existing regulations. The proposed solutions include comprehensive socialization, a personal approach to all related parties, and a revision of the Juvenile Justice System Law so that diversion can effectively aim to protect children's rights and restore social conditions fairly.
